Terms of Use

These terms are an agreement between you and SwansonX LLC (“SwansonX”, “we”) covering this website, the SwansonX music on it, and the song-making service (“Make your own”). By using the site — and in particular by creating an account, subscribing or making a song — you agree to them and to our Privacy Policy.

The short version

• SwansonX’s own music: listen and share links freely, but don’t sell it, re-upload it or use it commercially without asking.
• Songs you make: they’re yours to keep, share and post, within the rules below.
• Plans renew every month until you cancel, and you can cancel any time.
• Don’t use the studio to imitate real artists, copy other people’s work, or make hateful or harmful content.

Ownership

The music, lyrics, recordings and artwork in the SwansonX catalogue (the tracks and playlists published by SwansonX) are owned by SwansonX LLC, which retains all rights to them. Nothing in the catalogue is placed in the public domain, and no rights are transferred to you by listening to or downloading it. Songs made by other people with the studio and posted to the community playlist belong to the people who made them (see Part 2).

What you may do

• Stream and listen for your own personal enjoyment.
• Download tracks, where a download is offered, for personal listening.
• Share links to this site, to any track, or to any playlist.
• Mention the music and quote short passages of lyrics when writing or talking about it, with credit.

What you may not do

• Sell it. You may not sell, license, sublicense or otherwise charge anyone for this music, in whole or in part, in any form.
• Redistribute it. Don’t re-upload the audio to streaming services, download sites, file sharing networks or any other platform. Link here instead.
• Claim it. Don’t present this music as your own work, or register it with any distributor, rights organisation or content-identification system.
• Monetise it. Don’t use it in advertising, in monetised videos or streams, in games or apps, or in any other commercial project without written permission.
• Remix or sample it for public release, or create derivative works from it, without written permission.
• Train on it. Don’t use this music, its lyrics or its artwork as training data for machine learning or AI models, or to generate voice or style imitations.
• Circumvent, scrape or bulk-download anything on this site, or attempt to reach files that haven’t been published.

How songs are made

Songs are made with artificial intelligence. Your description and choices are sent to third-party AI services that plan the song and write the lyrics (Anthropic’s Claude), record the music (ElevenLabs) and paint the cover (OpenAI). The music is powered by ElevenLabs. Results vary: a song may not turn out exactly as you imagined, and AI output can occasionally resemble existing works.

Accounts and age

You need an account to make songs, and you must be at least 13 years old to have one. You must be at least 18 (or have a parent or guardian’s permission) to buy a plan or extra songs. You’re responsible for activity on your account.

Plans, renewal and cancelling

• Plans renew automatically every month at the price shown when you subscribed, and are charged to your saved payment method until you cancel.
• You can cancel any time from Manage billing on your account page. Your plan stays active until the end of the period you’ve paid for and then stops; you won’t be charged again.
• Each plan gives a number of songs per monthly period. Unused songs don’t roll over. Extra songs bought separately don’t expire while your account is open.
• If we change a plan’s price, we’ll tell you before it applies to you, and you can cancel before it does.
• Payments are processed by Stripe. We never see or store your full card details.

Refunds and song credits

• If a song fails to be made, the song is automatically credited back to your account.
• Before a song is recorded you can review it. If you discard a draft, the song is credited back for up to 3 discarded drafts in any 30 days; after that, a discarded draft uses the song.
• Otherwise, payments are non-refundable, except where the law requires a refund. If something went wrong, contact sean@swansonx.com and we’ll look at it fairly.

Who owns the songs you make

• As between you and SwansonX, the songs you make — lyrics, audio and cover — belong to you, together with the ideas and lyrics you give us. We claim no ownership of them.
• You give SwansonX a licence to store, process and play your songs to run the service for you, and — only if you post a song to the community playlist — to stream and display it publicly on this site until you take it down.
• You may keep, download, share and post your songs, including on social media and video platforms. You may not release them on music streaming services (such as Spotify, Apple Music or SoundCloud) — our music provider, ElevenLabs, doesn’t permit it under any licence — and you may not use them in film, TV or radio, or sell or license them to others.
• AI-generated material may not be protected by copyright in some countries, and we can’t guarantee a song is unique or that any distributor or platform will accept it.

What you may not make

These rules include the usage policies of the AI services we use, and apply to everything you type in and everything you make:

• Don’t ask for a song to imitate a real, identifiable artist or their voice, or present a song as being by someone it isn’t.
• Don’t submit lyrics or other material you don’t own or have permission to use. By submitting lyrics, you confirm you have the right to.
• No content that sexualises minors, promotes violence, terrorism or self-harm, or attacks people for who they are (race, religion, gender, sexuality, disability and similar).
• No harassment, threats, or content targeting a real private person.
• Don’t use the service to deceive people, to break the law, or to get around its limits (for example, automated or bulk use).

We may refuse a request, remove a song from the community playlist, or suspend an account that breaks these rules. Serious or repeated breaches may end your account without a refund.

The community playlist

Posting a song makes it public. Listeners can report a song, and a reported song is hidden until we review it. You can take your own song down at any time.

Copyright complaints

If you believe something on this site infringes your copyright, email sean@swansonx.com with: your contact details; the work you believe is infringed; a link to the material on this site; a statement that you have a good-faith belief the use isn’t authorised; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them, with your physical or electronic signature. We’ll remove material that we find, or are properly notified, to be infringing, and may end the accounts of repeat infringers.

The site itself

This site and the song-making service are offered “as is”, without warranties of any kind, and with no guarantee that they will be available, uninterrupted or error-free. Tracks and features may be added, changed or removed at any time.

Liability

To the extent the law allows, SwansonX isn’t liable for indirect or consequential losses, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before it. Nothing here limits rights you have under consumer law that can’t be limited.

Enforcement

If you use SwansonX’s music or the service in a way these terms don’t allow, permission to use it ends immediately, and we reserve the right to pursue any remedy available — including takedown requests to the platform hosting it.

Changes and contact

We may update these terms; the date at the top changes when we do, and we’ll give subscribers notice of any change that matters to them. These terms are governed by the laws of the State of Minnesota and of the United States. Questions: sean@swansonx.com.
